Statement from the Public Prosecutor at the Court of Appeal of Rabat:
- Following what has been shared on certain social media platforms regarding a statement attributed to the family of detainee Mohamed Ziane, alleging that he is on a hunger strike on the grounds that he considers himself arbitrarily detained since Friday, 21/11/2025, the date on which he would have, according to them, completed the custodial sentence issued against him.
- To clarify matters for public opinion, the Public Prosecutor at the Court of Appeal of Rabat specifies that the person concerned has already been convicted in two separate cases. In the first, a final ruling was issued against him, sentencing him to three years of imprisonment, the enforcement of which began on 21/11/2022.
- While serving this sentence, the investigating judge at the Court of Appeal of Rabat decided, on 10/01/2024, to place him in provisional detention in connection with a second case involving acts of embezzlement and misappropriation of public funds. In this case, a criminal judgment was issued and then confirmed on appeal on 07/05/2025, sentencing him also to three years in prison. This ruling is currently subject to an appeal before the Court of Cassation filed by the detainee, which makes the continuation of his detention after 21/11/2025 perfectly consistent with the law, since he remains legally in provisional detention in connection with this case.
It should be noted that the defense, convinced of the existence of two separate orders keeping him detained in two different cases, submitted on 04/11/2025 a request before the Court of Appeal of Rabat aimed at merging the two sentences issued against him.
The Public Prosecutor submitted this request to the competent judicial formation during the hearing of 12/11/2025, and the case was postponed to 26/11/2025 at the request of the defense.
In view of the above, the continuation of the detention of the person concerned is in no way arbitrary. It is a measure provided for by law as long as the second case has not yet resulted in a final ruling.
The Public Prosecutor remains committed to the rigorous and lawful application of the law regarding the legal status of the person concerned.
