The Public Prosecution intensifies visits to custody facilities and reduces pre trial detention

In a speech delivered on the occasion of the opening of the judicial year, in the presence in particular of Mohamed Abdennabaoui, Delegate President of the Superior Council of the Judicial Power, as well as chamber presidents, judicial officials and several sector executives, Blaoui specified that these complaints are distributed as follows: 29,499 complaints at the level of the courts of appeal, of which 27,651 were settled, representing 94 percent, and 545,473 complaints before the courts of first instance, of which 497,730 were processed, representing 91 percent.

In addition, the number of reports recorded during the past year reached 2,496,240, of which 2,320,092 were executed, showing a positive evolution of 0.74 percent.

According to the President of the Public Prosecution, these reports are distributed between the courts of appeal, which processed 84,178 reports out of 88,925, representing more than 95 percent, and the courts of first instance, where 2,235,914 reports were processed out of 2,407,315, corresponding to a completion rate of 93 percent.

In addition, approximately 815,260 electronic reports relating to road traffic offences were recorded, for which all the necessary legal procedures were initiated.

Decline in pre trial detention

Regarding the management of pre trial detention, Hicham Blaoui indicated that the notion of provisional detainee has undergone “a significant change” following the new amendments to the Code of Criminal Procedure. From now on, in accordance with Article 618, a provisional detainee is defined as “any accused person who is in the investigation or trial phase and has not yet been the subject of a final judgment or a definitive judicial decision”.

He specified that this development led to a notable decrease in the pre trial detention rate, which stood at 8.84 percent at the end of December 2025, representing 8,785 provisional detainees out of a total prison population of 99,366 inmates.

Even on the basis of the former definition of pre trial detention, which maintained this status until the issuance of a final judgment having the force of res judicata, Blaoui underlined that the pre trial detention rate at the end of December 2025 stood at 29.17 percent, compared with 31.79 percent during the same period of the previous year.

He stated that this is “a rate never reached before”, reflecting the particular attention paid by the judicial authority to the rationalization of pre trial detention and to the processing of the files of detainees within reasonable timeframes.

Visits to custody facilities

The President of the Public Prosecution also highlighted the “significant efforts” made by prosecutors in the protection of the rights and freedoms of individuals, particularly through the visits carried out by magistrates to places of deprivation of liberty.

In this regard, the number of visits to custody facilities reached 22,944 visits during the past year, while 19,286 visits were legally scheduled, representing a completion rate of 118.97 percent.

In addition, in 2025 the public prosecutors’ offices carried out 201 visits to mental and psychiatric care institutions, compared with 136 visits legally scheduled and 186 visits conducted in 2024, representing a completion rate of 148 percent.

As for penitentiary institutions, the number of visits carried out during the same year reached 1,186 visits, while 888 visits were scheduled, representing approximately 134 percent.

Hicham Blaoui concluded that these figures demonstrate “the sustained attention paid by the public prosecutors’ offices to the protection of the rights and freedoms of individuals”.
